Buyer (User):

The natural or legal person who enters their information when registering on the platform.

This agreement governs the terms of use of the SaaS (Software as a Service) based real estate management service purchased by the Buyer through emlakprotakip.com, and the rights and obligations of the parties, within the framework of Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation.

The Emlak Pro Takip platform covers the following digital services:

• Real estate portfolio management
• Lease agreement tracking and reminders
• Payment plan and collection management
• Maintenance/request management
• Inter-office listing sharing network
• Mobile app access (iOS and Android)

The services are cloud-based and require an internet connection. No physical product is delivered.

• Prices include VAT.
• A prepayment discount may apply to annual subscriptions.
• Prices may be changed with 30 days' prior notice.

• Payments are made by credit/debit card or bank transfer.
• For monthly subscriptions, payment is collected automatically at the start of each period.
• If payment fails, access to the service is suspended; the subscription is terminated if payment is not made within 7 days.

Pursuant to Article 49 of Law No. 6502 and the Distance Contracts Regulation:

• The Buyer may exercise the right of withdrawal for digital content and services within 14 days of the contract date without giving any reason.
• However, the right of withdrawal ends the moment service performance begins with the Buyer's consent (activation/login). This is clearly disclosed to the Buyer on the purchase screen, and the Buyer's explicit consent is obtained.
• To exercise the right of withdrawal, it is sufficient to send written notice to [email protected].

The separately published Service Cancellation and Refund Policy applies for details.

• Emlak Pro Takip aims for 99% annual uptime.
• Planned maintenance work is announced in advance.
• Outages caused by technical failures are compensated by extending the service period.
• No liability arises in cases of force majeure (natural disaster, war, cyberattack, etc.).

Personal data is processed under Law No. 6698 (KVKK). Please review our Privacy Policy for details. User data is not shared with third parties for marketing purposes.

The platform's software, design, and content belong to Emlak Pro Takip. The user may only use the platform within the scope of the agreement, and may not copy it or reverse-engineer it.

• By the User: May be cancelled at any time; access continues until the end of the current period.
• By Emlak Pro Takip: May terminate without prior notice in case of violation of the terms of use, non-payment, or detection of use harmful to the platform.

This agreement is subject to Turkish Law. The Consumer Arbitration Committee is applied to first for disputes; Antalya Courts and Enforcement Offices have jurisdiction in litigation.

By checking the box "I have read, understood, and accept the Distance Sales Agreement" when registering on the platform, the user is deemed to have accepted this agreement.
